Terms of Sale and Licence
Effective October 21, 2026. These terms apply when you buy a hipaa.systems compliance kit (the "Kit"). By buying or downloading the Kit you agree to them. The Kit is offered for business and professional use, not for personal, family or household use.

1. Who you are buying from
Our orders are processed by Creem — Armitage Labs OÜ (Creem), Tallinn, Estonia — our reseller and the Merchant of Record for all our orders. Creem sells the Kit to you, takes payment, adds and remits sales tax or VAT where it applies, issues your receipt and processes refunds and chargebacks, under its own buyer terms. Creem's name appears on your statement.
The Kit is licensed to you by FOP Andrii Katchyk, an individual entrepreneur registered in Ukraine ("we", "us"). Contact: hello@hipaa.systems.
2. What you get
- The edition you buy (for example the Therapy Practice Edition): the documents, workbooks, registers, implementation guide, playbooks and filled-in example listed on its product page at the time of purchase, as Word, Excel and fillable PDF files, delivered by download.
- 12 months of updates from the date of purchase (section 5).
- 30 days of product support by email (section 7).
3. Your licence
When you pay, we grant you a non-exclusive, non-transferable licence for one legal entity — including its trade names (DBAs) and all of its locations — to:
- copy, edit and adapt the Kit for that entity's internal HIPAA program;
- give the adopted policies to its workforce and the patient forms to its patients;
- provide copies of its adopted or completed documents, and relevant excerpts of the Kit, to its attorneys, auditors, insurers, payers, regulators, vendors and other professional advisers, as reasonably needed for that entity — they may not reuse the Kit for anyone else;
- keep and use its copy indefinitely, including after the update period ends.
You may not:
- resell, sublicense, publish or share the Kit's files, or any blank or substantially unchanged version of them, with anyone outside that entity;
- use one licence for more than one legal entity, or for the clients of a consultant, managed service provider or other adviser;
- use the Kit to create a product or service that competes with it.
A separate legal entity needs its own licence. A second edition for the same legal entity (for example a practice that offers both therapy and medical services) costs $49.
4. Price
The price is shown on the product page and at checkout; Creem adds any sales tax or VAT that applies. A launch price applies only for the stated period after sales open; after it ends, the regular price applies.
5. Updates
- For 12 months after purchase you receive each new version of your edition, with a changelog and a "law checked as of" date, by email and download.
- After 12 months you may renew updates for $79 a year. Renewal is optional. Without it you keep the last version you received; it will not be updated.
- Fixes of our own errors — a legal or technical mistake in the Kit — are sent free of charge to every buyer of the affected version, whenever we find them, with or without an active update plan.
- Updates follow changes in the federal HIPAA rules and HHS guidance. We don't promise any particular update, its timing, or coverage of state law.
6. Refunds
Requests made within 14 days of purchase qualify for a full refund. The details — including damaged files and the wrong edition — are in our Refund Policy. Refunds are paid by Creem.
7. Support
For 30 days after purchase we answer questions about how the Kit works: where a document is, how the workbook, lists and statuses work, how to get a new version, and what the Kit's own instructions mean.
Support does not include: deciding whether a breach is reportable, interpreting state law, judging whether a vendor or product meets HIPAA, legal review of your documents, editing documents for you, or any question that involves real patient information.
Never send us protected health information, patient records, incident details or completed forms.
8. What the Kit is — and is not
- The Kit is an implementation and documentation aid. It sets out our reading of the federal HIPAA rules and our recommendations as of each document's version date.
- It is not legal or medical advice, and using it does not create an attorney-client or any other professional relationship. It has not been reviewed by an attorney.
- We sell downloadable document templates and implementation guidance. We do not provide clinical, legal or consulting services, do not assess your practice's compliance, and do not receive or process patient data.
- Buying or using the Kit does not by itself make your organization compliant with HIPAA. That depends on what your organization does: adapting the documents, completing its risk analysis, putting safeguards in place, training its workforce and keeping its records current.
- The Kit is not a certification and is not approved or endorsed by HHS, OCR or any government body.
- It covers federal HIPAA and points out selected areas where state law often differs; it is not a review of the laws of any state, and it does not implement 42 CFR Part 2.
- Vendor information in the Kit (for example which plans include a BAA) is dated and can change; confirm it with the vendor before you rely on it.
9. No warranty
Except as stated in sections 5 and 6, the Kit is provided "as is", without warranties of any kind, express or implied, including fitness for a particular purpose or that it meets the requirements of any law for your organization, to the fullest extent the law allows.
10. Limitation of liability
To the extent the law allows, our total liability for any claim relating to the Kit is limited to the amount you paid for it, and we are not liable for indirect, incidental, special or consequential damages, including fines, penalties, settlements or lost profits. Where the law does not allow these limits, they apply only as far as it permits.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, such as liability for fraud, fraudulent misrepresentation, or wilful misconduct or gross negligence where the law prohibits limiting it. This section does not limit our refund, update and error-correction commitments.
11. Changes to these terms
We may change these terms for future purchases. The terms in effect when you bought the Kit apply to that purchase, unless you choose to accept newer terms that are more favourable to you.
12. Governing law and disputes
Payment, tax, checkout and the processing of refunds are governed by Creem's buyer terms. The Kit and your licence are governed by the laws of Ukraine, and disputes about them are subject to the jurisdiction of the courts of Ukraine. Nothing in this section limits any mandatory right or forum available to you under applicable law. Before starting any formal dispute, please write to us at hello@hipaa.systems — most problems are solved by a reply.
