Is Elation Health HIPAA compliant?
Cloud EHR and practice management for independent primary care. Its standard BAA is accepted online and is effective from the date the practice clicks "I agree".
Elation Health signs a Business Associate Agreement. Elation publishes a standard Business Associate Agreement that "is effective as of the date Covered Entity presses 'I agree'" and covers the services under the practice's existing agreement with Elation.
A BAA alone does not make its use HIPAA compliant: set it up as described under What to configure, and cover it in your risk analysis.

What you still have to configure
- Accept the BAA online and keep a copy with the date you accepted it — that date is when it takes effect. source
Limitations
- The BAA allows Elation to create de-identified data under 45 CFR 164.514(b) and use or disclose it for any purpose, and to use PHI for data aggregation services (164.504(e)(2)(i)(B)). source
- Breaches are reported to you without unreasonable delay and no more than 30 days after discovery. source
- The BAA asks the practice to tell Elation about a patient's changed or revoked permission, or an agreed restriction, at least 15 days before it takes effect (§4(b)–(c)). That is a contract term, not a reason to delay a patient's rights; the BAA itself gives mandatory Privacy Rule provisions priority (§9). Ask Elation how restrictions are applied in the system. source
